 马胜利写意花鸟画，存在三个要素，即构造、意境和笔墨。构造指画面结构，包括花石树木、禽鸟鱼虫的造型、布局、构图经营以及设色等。花鸟的意境由情趣而生发，它是花鸟画的灵魂。本来笔墨作为形式语言和设色一样都应属于构造范畴，但写意花鸟里，它却有独立意义，因而自成一个要素。由花鸟三要素构成花鸟画的三美，即构造美、意境美、笔墨美或色彩美。这三美既是花鸟画创造的审美取向，也是品评的理论框架。凡是花鸟画大家，无不在“三要”齐备的前提下，全力以赴追求“三美”皆备，突出审美取向，形成独树一帜的个人图式、艺术趣味和魅力。

马胜利一直追求着富有象征意味花鸟形象的构造之美。在他的画面中，从不凝固在一个僵化的模式之中，即使是同一题材他也层出不穷地创新，呈现结构错综变化之极致。他的构造美表现在造型上，注重的是写神传情，是对“气韵”、“神韵”不倦地追求和独特的表现。其点、线、面形成的节奏感，其黑、白、灰的转换关系，以及他创造的笔墨色彩形式语言，蕴含着诸多现代绘画元素，无不充溢着自然生命的勃勃生机和画家对生命之美的由衷赞吧。画面的形式安排，如前无古人的、带有明显现代构成意味的构图处理，以及大胆运用西画色彩观念，将丰富的色彩融入画面之中，都可以明显看出画家试图以西方的绘画语言去转变中国画艺术的语言式，将西画的空间关系融入中国画的开合中，以寻求西画与中国画的融通化合。这种用自己的方法去发现，去表现他所开拓出来的主题的构造之美，使马胜利花鸟画形成了独具个性的“端庄杂流丽，刚健含婀娜”的新格局。

马胜利花鸟画的意境美在于一个“情”字，“一花一叶总关情”。多年来，他总是以一颗充满爱意之心，把热爱自然，热爱生命的理想，寄情于笔端。意是寄情，境由心造，情景交融构成作品的意境。画家在生活中只有对景有了强烈的感情，才会鼓起想象的羽翼，只有胸有情思，注情入景，笔下自有韵致，才会创作意境美的作品。在这一前提下，马胜利具体表现的题材，如《素花芳香图》中竟相开放的牡丹凝香吐艳；《烟云锦欣》中树石交织的花影婆娑；《泽畔清韵图》中禽鸟的绵绵情意，乃至《墨竹图》中的醉笔挥洒，都不是简单的生活再现，也不是自然现象的罗列，而是用具体的，感情的形象来表达作者对客观事物的看法，并通过想象甚至联想，体现在一种诗情画意和独特的观照方式。这种方式与其精神人格相合，与心灵境界默契，摆脱了通常花鸟的浅薄，透出一种文化精神的意味。马胜利的意境美使他的作品“于天地之外，别构一番灵奇”，具有打动读引发思绪的生命力，从而在情牵梦绕中萌生诗意，更耐咀嚼品味。

马胜利没有忽视笔墨书法化的表情性，墨以笔为筋骨，色亦以笔为筋骨，讲究笔力、笔势、笔意的传达。但他不墨守以墨为主，以色辅之的老套，也不拘泥于一笔一墨的精妙和设色的单纯。他总是以笔趋形、以笔传神，以笔抒情，以笔生趣，以笔施墨，以笔著色，让笔墨设色服从于特定的情景与感受的表现，据此分别体用，互换宾主，不但像任伯年一样地不舍众法，融双勾、泼墨、点 、没骨为一体，甚至把山水画的皴擦点染引进写意花鸟画中，而且善于旁参西方构成的意匠与色彩的表现，从而造成了丰富的语言系统。在这丰富的语言系统中，马胜利一方面因情思与题材之异而取用词汇，另一方面则分发挥了笔痕墨迹的浑厚朴茂和色彩的尖新浑融。他用色对比灿烂，又和谐统一，对比则分块处理，和谐则渐次过渡。在他的笔下，留下了过程的墨迹，亦显露出运笔的心境。

他的笔情墨越始终和花鸟图式、造型结构、艺术趣味、意绪散发互为表里，其画才内涵奥妙，饶有风神。就此而言，马胜利的花鸟画对“三美”的追求已是一种自觉的行为。

毫无疑问，马胜利的写意花鸟在“横”的借鉴和“纵”的继承中，没有淹没自己，而是独出机杼，常画常新。他用以实现出新的主要凭借之一便是写生。走进大自然，贴近生活是他锐意出新的最佳途径。他在写生中注意深入研究观察对象，力求“穷理尽性”尽精微致广大，升华感受；继而以中国画特有的笔法线条，在物我连接上，

进行既状物又抒情的概括，同时注入个人的气质心情。再则以默写的功夫来不断涵养对物写生的取舍，合造化与心愿，变自然为艺术。正是由于他把写生当作了通向创作源头的桥梁，所以能顺利地避开了只知临摹者的为法所缚，不再以古人的眼光看自然，不用别人的步履闯世界。
